Dallas District Office of the FDA, in consultation with the Center for Food Safety and Applied Nutrition (CFSAN), have concluded that if your product, with its current hiccups claims, were marketed as a dietary supplement, consistent with the 1994 Dietary Supplement Health and education Act (DSHEA), the product could be legally marketed. Your product labeling and its accompanying literature should prominently display the disclaimer specified in section 6(C) of the DSHEA.
